Addendum

At the request of the seller, first right of refusal for
her son.
1. Situated within the green zone and protected by the Act
to Preserve Agricultural Land and its Activities.
2. MAPAQ credit applied to municipal and school taxes.
3. All measurements are approximate and based on the
cadastral lot plan and the municipal tax information. The
seller does not warrant the land surface area, quantity of
workable acres, distance of the drainage pipes or the area
covered by the drainage system.
4. Excluded from the sale are the residence and shed
bearing civic number 961 chemin Fairview, Hinchinbrooke
(Québec) J0S 1H0. The seller will supply at his cost and
without delay new lot numbers describing the actual lot
area which he will retain with the residence, which will
not exceed ½ hectare. As soon as the new lot numbers have
been published, the parties will sign and publish a
declaration to this effect.
5. If the buyer requires a technical description or any
other document of the entire farm from a land surveyor, the
buyer shall assume all costs.
6. LEASE TO BE CREATED IN FAVOR OF THE SELLER
a) The buyer shall allow the seller to retain a parcel
measuring about 1 acre with agricultural buildings, see
attached farm plan, in the form of a long-term lease of 39
years.
b) The seller will pay a land surveyor to draft a
technical description of the land and buildings to be
leased.
c) The seller shall only pay 100$/year for lease plus
applicable municipal and school taxes for leased parcel.
d) The buyer agrees to collaborate in good faith with the
seller to obtain the necessary authorizations.
e) The lease is transferable with the sale of the
residence/garage/shed/barn.
f) The property, buildings and land are leased for
agricultural purposes only. Furthermore, the lessee agrees
to use accepted agricultural practices.
g) The lessee will be responsible for obtaining a regular
insurance policy on the property and assumes full
responsibility of any buildings or structures.
h) A plan of the lease is attached to this promise to
purchase and signed by the parties.
